Builders Challenge

The Florida Home Builders Association is leading a challenge to the city of Tallahassee's mandatory inclusionary zoning ordinance requiring builders to set aside 10% of homes in large developments for affordable housing. The Tallahassee Builders Association and Tallahassee Board of Realtors joined the state builders group in the civil suit, which claims the regulation is an "unauthorized tax.'' Builder Dave Wamsley, however, owner of K2 Urbancorp, is voluntarily incorporating the requirement in a project approved before the ordinance became effective, to test if it can be economically viable.
